Service Agreement
To Ensure All Parties are on the Same Page Prior to Starting Service
Access: By agreeing to this contract, you allow ORCA Pools to be present on the property where your Pool/Spa is located for any allocated time necessary to complete the tasks required for the maintenance of said Pool/Spa. As such, it is the property owner’s responsibility to maintain safe and clear access to the Pool/Spa. If your Pool/Spa is in a secured area, we ask you to provide us with a key marked with your name or code necessary to get into the area. For the safety of our staff and prevention of liability, the path to and surrounding area of the Pool/Spa must be clear of obstacles (Toys, Furniture, Yard Equipment, etc.) and pets prior to the arrival of our maintenance technician. No inflatable toys or furniture shall be in the Pool prior to the arrival of our maintenance technician. The technician reserves the right to cancel a job for the week if there is no access (locked gate, unsafe conditions) to pool/spa at time of arrival and return the following week.
Water Level: It is the customer’s responsibility to maintain the water level. We cannot be responsible for any equipment damages or other issues that arise as the result of low water level in the pool.
Inclement Weather: In the event of rain or freezing weather, we will perform a chemical and equipment check only on the pool, leaving out those items that require the use of a pole. No refunds will be given for such visits.
Vacation/Time-Off: ORCA Pool will be closed, and service will not be provided as follows: 1) Three (3) weeks during the year (Client will be notified of the week in advance), 2) New Year’s Day, 3) Memorial Day, 4) Fourth of July, 5) Labor Day, 6) Thanksgiving week, and 3) Christmas 2 weeks off. In the event of an emergency, ORCA Pools will make every effort to return your calls and answer emails. Emergency services are provided at a separate agreed upon rate quoted on a case by case basis.
Out of 52 weeks in the year, we only charge for 48. Some months have 5 weeks. These remaining weeks offset our holiday closures and any inclement weather days for which we are closed.
Payment Terms: Invoices are billed on the 1st of each month, for the “current month” and due by the 26th of the current month. To avoid a $30.00 late payment fee, all amounts must be received before the 1st of the following month. Unless prior payment arrangements have been made, any unpaid invoice will result in “suspension” or “cancellation” of service, and the referral to a collection agency. Service will resume upon receipt of payment. There could be additional charges to restore the pool/spa to a swimmable condition. There will be a $30.00 fee for all late payments.
You agree to pay ORCA Pool & Spa up to 1⁄3 in collection costs to collect any unpaid balance, including attorney’s fees and court costs. Any disputes arising hereunder, whether in contract or tort, shall be governed by the laws of the State of California and the appropriate court in Los Angeles County, we will have exclusive jurisdiction and venue.
Cancellation: Agreements can be cancelled by either party at any time.
Your Monthly Plan: Weekly Pool Cleaning : $185
Additional Charges Throughout the Year :
-Filter Wash every six months: $145
– Pool algaecide treatment once a year for $95 before summertime
